Gear Fool+ Q4 2026 Quarterly Hunt Giveaway Official Rules
(“Official Rules”)

By participating in the Gear Fool+ Q4 2026 Quarterly Hunt Giveaway (the “Giveaway”), you (“entrant” or “you”) agree to abide by and be bound by these Official Rules and the decisions of Sponsor, which are final and binding in all respects and not subject to appeal.

1. SPONSOR. The sponsor of the Giveaway is Built to Hunt Marketplace, LLC dba Gear Fool, PO Box 250, Cedar City, UT 84721 (“Sponsor”).

2. ELIGIBILITY. The Giveaway is offered and open only to legal residents of the fifty (50) United States and the District of Columbia (U.S.), excluding Florida, New York, Rhode Island, and Washington, and legal residents of Canada, excluding Quebec. Void elsewhere and where prohibited by law. At the time of entry, each entrant must be at least twenty-one (21) years of age or older and have a valid hunter safety number and/or valid hunting license issued by any U.S. state, Canadian province, or other jurisdiction from which entry is permitted under these Official Rules. Employees, contractors, directors, officers, and agents of Sponsor, its parent, affiliates, subsidiaries, distributors, sales representatives, advertising, promotion, and judging agencies, and all other service agencies involved with the Giveaway, as well as the immediate family members (spouse, parents, siblings, and children) and/or those living in the same household of each such employee, contractor, director, officer, or agent are not eligible to participate in the Giveaway. The Giveaway is subject to all applicable federal, state, provincial, and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Giveaway. Winning the Prize is contingent upon fulfilling all requirements set forth herein.

3. GIVEAWAY PERIOD. The Giveaway begins on October 1st, 2026, at 12:01 AM Mountain Time (“MT”) and ends on December 31st, 2026, at 11:59 PM MT (the “Giveaway Period”). All Entries (defined below) must be received by the end of the Giveaway Period to be valid. NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

4. PRIZE AND ODDS OF WINNING. One (1) winner will be selected to receive the prize as set forth in the table below (the “Prize”). The odds of winning depend on the total number of eligible Entries received. It is expressly understood that Sponsor is under no obligation to the entrants, potential winner, and winner, other than as expressly set forth herein.

Prize Title: 2027 New Mexico Rifle Elk Hunt

Prize Description: Join an HFA-endorsed outfitter on a 2027 five-day, one-on-one guided New Mexico rifle elk hunt. This hunt will take place in Unit 51 or 52 of New Mexico and will provide an opportunity to harvest a 250-300+ class bull elk. The outfitter will provide the landowner tag as part of the hunt package; the winner does not need to apply for or successfully draw a tag.

Approximate Retail Value (“ARV”): $15,500.00 USD

Prize Dates: TBD, 2027 Season

Prize Details: Winner is responsible for travel, fuel, gratuities, and any other expenses not expressly included as part of the Prize. No hunting equipment (such as rifles, ammunition, or gear) is included unless expressly stated in the prize description; the winner is responsible for providing all personal hunting equipment and gear necessary for the hunt.

5. ENTRY FOR GIVEAWAY. There are two (2) methods of entry. As used herein, “Entry” (and/or “Entries”) refers to a participant’s submission via the Gear Fool+ Membership Method or the Free Mail-In Method in accordance with these Official Rules:

(a) Gear Fool+ Membership Method: A Gear Fool+ membership may be obtained by visiting www.gearfool.com. Each Gear Fool+ member in good standing during the Giveaway Period will automatically receive one (1) entry into the Giveaway. Gear Fool+ members may earn additional entries based on individual purchases made at www.gearfool.com during the Giveaway Period as follows: (i) a single purchase totaling $250–$349 earns an additional four (4) entries for that purchase; or (ii) a single purchase totaling $350 or more earns an additional ten (10) entries for that purchase. Additional entries are awarded per qualifying purchase transaction; a single purchase qualifies for only one tier (the tiers do not stack within the same transaction). For example, a purchase of $400 earns ten (10) additional entries (not fourteen). Multiple separate qualifying purchases during the Giveaway Period may each earn additional entries, subject to the maximum entry limit set forth in Section 6. Entries for this entry method are not valid until the member’s payment is processed. Sponsor is not responsible for technical or human malfunctions of any kind in processing payments. If a qualifying purchase is returned, refunded, or charged back at any time (whether before or after the drawing) in accordance with Sponsor’s refund policy (available at www.gearfool.com/policies/refund-policy), the additional entries associated with that specific purchase are automatically forfeited. If, after the drawing, a winner returns, refunds, or charges back any qualifying purchase that earned additional entries, the win will be invalidated and the Prize awarded to the alternate winner.

(b) Free Mail-In Method: To enter without being a Gear Fool+ member or making purchases, you may, on a 3” x 5” index card, hand-print in blue ink your full name, complete home address including zip code, home telephone number with area code, email address (if available), and the words “Gear Fool+ Q4 2026 Quarterly Hunt Giveaway Entry” and mail the index card via first-class mail in a properly stamped envelope to: Built to Hunt Marketplace, LLC, Q4 2026 Quarterly Hunt Giveaway Entry, PO Box 250, Cedar City, UT 84721 (a “Mail-in Entry”). Limit one (1) Mail-in Entry per index card. All Mail-in Entries must be mailed in separately. All Mail-in Entries must be received by the end of the Giveaway Period to be valid. Sponsor is not responsible for late, lost, damaged, illegible, or postage-due mail. Mail-in Entries become the exclusive property of Sponsor and none will be acknowledged or returned.

6. ENTRY LIMITS. Limit of fifteen (15) Entries per entrant per Giveaway Period for any method of entry, including via Mail-in Entries (which would require fifteen (15) separate index cards). Any Entry in excess of fifteen (15) Entries will be declared void and ineligible to win. Sponsor reserves the right, in its sole discretion, to void any and all Entries of an entrant who Sponsor believes has attempted to tamper with or impair the administration, security, fairness, or proper play of this Giveaway, and to cancel the Giveaway. In addition, if Sponsor determines, in its sole discretion, that an entrant made purchases primarily for the purpose of earning additional entries with the intent to return those purchases after the drawing, the Sponsor may disqualify the entrant and void any Prize awarded. All Entries become the exclusive property of Sponsor and will not be acknowledged or returned. Entries and points do not carry over from one quarter to the next; all Entries reset at the end of each Giveaway Period.

7. DRAWING, WINNER SELECTION, AND PRIZE FULFILLMENT.

(a) Drawing. On or about January 15th, 2027, one (1) potential winner will be selected at random from among all eligible Entries received during the Giveaway Period. Immediately following the selection of the potential winner, one (1) alternate winner will be selected at random.

(b) Notification and Verification. Sponsor’s staff will attempt to contact the potential winner using the telephone number and/or email address provided by the potential winner for up to three (3) weeks following the date of the drawing. Each potential winner may be required to furnish proof of identification and hunting license to determine eligibility.

(c) Winner Requirements. Before being declared an official winner, the potential winner must: (i) execute and return a Declaration or Affidavit of Eligibility/Liability and Publicity Release and applicable tax documentation no later than ten (10) business days after the time such forms are postmarked as having been sent by Sponsor; and (ii) for guided hunt Prizes, execute the respective outfitting organization’s safety and liability agreements and fulfill any other of the outfitter’s requirements before participating in the hunt.

(d) RESIDENTS OF CANADA. Before being declared a winner, a potential winner who is a resident of Canada must first correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question to be completed at a mutually convenient time by telephone.

(e) Forfeiture and Alternate Winner. If the potential winner: (i) is found to be ineligible or not in compliance with these Official Rules; (ii) declines to accept the Prize; (iii) cannot be contacted within three (3) weeks of the drawing date; (iv) fails to correctly answer the skill-testing question (for Canadian residents); (v) fails to execute the required affidavit, release, or other paperwork within the required timeframes; or (vi) forfeits the Prize in writing, then the Prize will be forfeited and awarded to the alternate winner. If the alternate winner is also found to be ineligible or otherwise unable to accept the Prize for any of the foregoing reasons, Sponsor may, in its sole discretion, select an additional alternate winner at random from among the remaining eligible Entries, or may elect not to award the Prize.

(f) Prize Fulfillment. Sponsor will send a confirmation email, including instructions on how to redeem the Prize, to the winner and the respective hunt guide/outfitter within three (3) weeks of Sponsor’s receipt and verification of all required paperwork from the winner. Sponsor will use reasonable efforts to coordinate mutually agreeable dates for the hunt with the winner and the outfitter; however, if the winner is unable or unwilling to participate in the hunt after reasonable attempts to schedule, or fails to appear on scheduled dates, the Prize will be forfeited and no cash or other substitute will be provided. All expenses not stated herein as part of the Prize are the winner’s responsibility. To the extent the award of any Prize is prohibited by law in the applicable jurisdiction, Sponsor will award an alternate prize of Sponsor’s choice of equal value.

8. TAXES AND TRAVEL COSTS ARE THE SOLE RESPONSIBILITY OF THE WINNERS. Winners are solely responsible for all federal, state, provincial, and local taxes, fees, or other costs, including, without limitation, any travel or transportation costs, associated with the receipt and use of any Prize. Each winner may be required to complete an IRS Form W-9 and will receive an IRS Form 1099-MISC for prize values of $2,000 or more.

9. GENERAL CONDITIONS. The Prize is not redeemable for cash, is non-transferable, and there is no substitution for the Prize; however, Sponsor reserves the right to substitute a prize of equal or greater value. Sponsor is not responsible for, and the winner will not receive, the difference, if any, between the actual value of the Prize at the time of award and the ARV stated in these Official Rules or in any Giveaway-related correspondence or materials. The depiction of the Prize in any advertising or promotional materials may not reflect the actual Prize delivered to the winner.

10. CONDITIONS OF PARTICIPATION. 

(a) By entering, you (i) acknowledge compliance with these Official Rules including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor which shall be final and binding in all matters relating to this Giveaway. Entrants who have not complied with these Official Rules are subject to disqualification and their entries will be void.

(b) If a dispute arises regarding who submitted an Entry, the Entry will be deemed to be submitted by the authorized account holder of the email address provided at the time of entry and he/she must comply with these Official Rules. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address. A potential winner may be required to show proof of being the authorized account holder.

(c) Sponsor reserves the right in its sole discretion to disqualify any entrant’s participation in the Giveaway if Sponsor determines or suspects that the entrant has attempted to undermine the legitimate operation of the Giveaway by cheating, hacking, deception, or other fraudulent, deceptive, or unfair playing practices. Sponsor reserves the right in its sole discretion to cancel, modify, or suspend this Giveaway at any time if fraud, technical failures, or any other errors or other causes corrupt the administration, security, integrity, or proper play of the Giveaway. In the event of cancellation, Sponsor will select the potential winner from among all eligible Entries received up to the time of such cancellation, in a manner determined by Sponsor to be fair, appropriate, and consistent with these Official Rules.

(d) Sponsor does not warrant that access to the Giveaway will be uninterrupted. Sponsor is not responsible for any problems that may arise, including but not limited to: (i) lost, interrupted, inaccessible or unavailable networks, servers, satellites, websites, or other connection, availability or accessibility problems arising in connection with or over the course of the Giveaway; or (ii) failed communications or communications that are jumbled, scrambled, delayed, or misdirected computer, telephone, or cable transmissions or hardware or software malfunctions, failures, or difficulties; or (iii) failure of personal computers and/or software and hardware configurations, any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical, or other errors in connection with the administration of the Giveaway, the processing of mail or entries, the offering or announcement of the Prize or in any Prize notification documents; or (iv) any other errors of any kind relating to or in connection with the Giveaway, whether human, mechanical, clerical, electronic, or technical in nature; or (v) the incorrect or inaccurate capture of information, or the failure to capture any information in connection with the Giveaway; or (vi) damage to a user’s system occasioned by participation in this Giveaway or downloading any information necessary to participate in this Giveaway.

(e) If Sponsor determines (in its sole and absolute discretion) that, for any reason, the Giveaway is not capable of running as planned, or the integrity and/or feasibility of the Giveaway is undermined by any event beyond the control of Sponsor, including but not limited to fire, flood, epidemic, pandemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state, or local government law, order, or regulation, order of any court or jurisdiction, hacking or infection by computer virus, unauthorized intervention, technical failures, or other cause not reasonably within the control of Sponsor, Sponsor reserves the right, at its sole and absolute discretion, to abbreviate, cancel, terminate, modify, or suspend the Giveaway and/or proceed with the Giveaway, including the selection of a winner in a manner it deems fair and reasonable, including the selection of a winner from among eligible Entries received prior to such cancellation, termination, modification, or suspension, without any further obligation. In the event of cancellation, Sponsor will randomly award the Prize from among all eligible, non-suspect Entries received prior to cancellation.

(f) Any attempt by any person to deliberately undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If any provision of these Official Rules or any word, phrase, clause, sentence, or other portion thereof should be held unenforceable or invalid for any reason, then that provision or portion thereof shall be modified or deleted in such manner as to render the remaining provisions of these Official Rules valid and enforceable. The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision.

11. INDEMNITY, RELEASE, AND LIMITATION OF LIABILITY. By entering the Giveaway or accepting any Prize, each entrant expressly agrees to indemnify, defend, and hold harmless, and does hereby forever waive, release, discharge, and covenant not to sue Sponsor and/or any of its past and present partners, owners, affiliates, members, managers, employees, agents, attorneys, advertising, public relations, promotional, fulfillment and marketing agencies, website providers, directors, officers, shareholders, contractors, successors, assigns, and insurers (collectively, the “Released Parties”), for and from any and all claims, debts, liabilities, demands, obligations, costs, fees, expenses (including reasonable attorneys’ fees), actions, and causes of action whatsoever, of every nature, character, and description (collectively, “Claims”), known and unknown, including but not limited to all Claims arising out of or in any way related to: (i) the Giveaway, including any Giveaway-related activity or element thereof, and the entrant’s entries, participation, or inability to participate in the Giveaway; (ii) these Official Rules (including the legality of these Official Rules or any portion hereof); (iii) entrant’s entry into and/or eligibility for the Giveaway; (iv) the negligence or willful misconduct of Sponsor or any Released Party; (v) the Prize (including without limitation the receipt, non-receipt, acceptance, rejection, possession, misuse, or use of the Prize); and (vi) any violation of any third-party privacy, personal, publicity, or proprietary rights. 

Additionally, as a condition of entering, each entrant agrees (and agrees to confirm in writing): (a) under no circumstances will any entrant be permitted to obtain awards for, and entrant hereby knowingly and expressly waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses and/or any rights to have damages multiplied or otherwise increased; (b) all causes of action arising out of or connected with this Giveaway, or any Prize awarded, shall be resolved individually, without resort to any form of class action; and (c) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred (if any), excluding attorneys’ fees and court costs. Entrant represents and warrants that he or she owns and/or has the authority to release the Claims stated herein.

Entrant expressly waives Section 1542 of the California Civil Code, which provides: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.” By entering the Giveaway, each entrant waives and relinquishes all rights and benefits that he or she may have under Section 1542 of the California Civil Code or any similar provision of the statutory or non-statutory law of any other jurisdiction, to the full extent that he or she may lawfully waive all such rights and benefits.

WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS GIVEAWAY, INCLUDING THE PRIZE, IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY SET FORTH ABOVE, SO SUCH LANGUAGE MAY NOT APPLY TO EVERY ENTRANT.

12. PUBLICITY RELEASE. Except where prohibited by law, each winner grants (and agrees to confirm this grant in writing, if requested) permission for Sponsor and those acting under its authority to use his/her name, address (city and state/province of residence), photograph, and/or likeness, for advertising and/or publicity purposes in any and all media now known or hereinafter invented without territorial or time limitations and without compensation.

13. GOVERNING LAW. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of Utah, without regard to conflicts of law principles. All entrants consent to the jurisdiction and venue of the appropriate state or federal court located in Utah.

14. PRIVACY POLICY. Information collected from entrants is subject to Sponsor’s Privacy Policy, which can be found at www.gearfool.com/privacy-policy. Entrants should be aware that Sponsor may be collecting non-public, personally-identifiable information about them in connection with the operation of the Giveaway. The Giveaway is hosted on servers in the United States, and the personal information entrants provide may therefore also be subject to laws of the United States. Subject to applicable law, Sponsor and Sponsor’s agents, affiliates, subsidiaries, representatives, or service providers may use entrants’ personal information submitted with entry for purposes of Prize fulfillment and/or for future marketing by Sponsor, such as to notify them of a product or Giveaway that Sponsor thinks may be of interest. Sponsor will not sell personal information submitted with entry to third parties.

15. PRECEDENCE. In the event of any conflict with any Giveaway details contained in these Official Rules and Giveaway details contained in other Giveaway materials (including, without limitation, any point of sale, online or print advertising), the details of the Giveaway as set forth in these Official Rules shall prevail.

16. OFFICIAL RULES REQUESTS. A copy of these Official Rules can be obtained by sending a self-addressed stamped envelope to: Gear Fool Q4 2026 Quarterly Hunt Giveaway - Rules Request, PO Box 250, Cedar City, UT 84721. Vermont residents may omit return postage. Entrants are hereby authorized to copy these Official Rules on the condition that it will be for the entrant’s personal use and not for any commercial purpose whatsoever.

17. WINNERS LIST. A list of the official winner will be posted at https://www.gearfool.com/pages/gear-fool-winners beginning on or around February 20, 2027.
